AITableFlow Terms of Service

These Terms of Service ("Terms") are a binding agreement between AI TABLE FLOW LLC ("AITableFlow," "we," "us," or "our") and the business or individual that accesses or uses our website at https://www.aitableflow.com (the "Site") and our services ("you" or "Customer"). Please read them carefully.
AI TABLE FLOW LLC is an Illinois limited liability company (File No. 18300931).
1. Acceptance of These Terms
By accessing the Site, subscribing to the Services, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you are entering into these Terms on behalf of a business, you represent that you are authorized to bind that business. If you do not agree, do not use the Services.
2. Description of the Service
AITableFlow provides a managed, AI-run front office ("Services") for restaurants. The Services may include an AI agent that answers calls and web/social messages, captures and (where integrated) books reservations, handles to-go orders, requests reviews, runs guest win-back, and manages CRM records on your behalf. The Services are delivered as a managed service built on top of the GoHighLevel platform and other third-party providers, and may integrate with reservation platforms (such as SevenRooms, OpenTable, and resOS) that you select. AITableFlow does not own or operate the underlying communications, CRM, AI, or reservation platforms; it configures and operates them on your behalf.
We may add, modify, or discontinue features of the Services from time to time.
3. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials and those of your team, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Customer Responsibilities
You are solely responsible for your use of the Services and for your communications with your own guests and patrons. In particular, you represent, warrant, and agree that:
- Lawful basis and consent. You have all necessary rights, lawful bases, and consents to contact the individuals whose information you load into or generate through the Services, including consent to receive calls, texts, and emails where required (for example, for guest win-back outreach).
- Compliance with communications laws. You are responsible for complying with all applicable laws governing your communications, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, state telemarketing and "do-not-call" laws, the CAN-SPAM Act, and all call-recording and monitoring laws — including Illinois' all-party consent requirement and the recording-consent laws of any other applicable jurisdiction.
- Accurate configuration. The hours, menu, reservation and to-go policies, scripts, and other information you provide to configure the Services are accurate and lawful.
- Reservation integrations. You are responsible for your relationship with, and the terms of, any reservation platform you choose to integrate (e.g., SevenRooms, OpenTable, resOS), and for the accuracy of availability and booking rules you configure.
- No prohibited use. You will not use the Services for unlawful, deceptive, harassing, or abusive purposes, to send spam, or to violate the rights of others.
- Your data. You are responsible for the legality of the data you provide and for honoring opt-out, deletion, and similar requests from your own guests.
You will indemnify AITableFlow for claims arising from your breach of this Section, as described in Section 12.
5. AI Services Disclaimer
The Services use artificial intelligence, including an AI agent and automated transcription and response generation. AI can make mistakes. Outputs may be inaccurate, incomplete, or inappropriate for a given situation — for example, in capturing a reservation, party size, time, or to-go order — and the AI may misunderstand guests or mishandle requests. You are responsible for reviewing and supervising the Services as appropriate for your restaurant, and for maintaining human oversight where outcomes matter. The Services do not provide professional, legal, financial, or other regulated advice, and nothing produced by the Services should be relied on as such.
6. Fees and Billing
- Subscriptions. The Services are offered on a subscription basis. Fees, billing frequency, and any usage-based charges are as presented at sign-up or in your order.
- Payment processor. Billing is handled through Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method on a recurring basis until you cancel.
- Free trials. Where a free trial is offered, the trial converts to a paid subscription at the end of the trial period unless you cancel before it ends. A valid payment method may be required to start a trial.
- Cancellation. You may cancel at any time as described at sign-up or by contacting us. Cancellation stops future renewals; it does not retroactively cancel the current billing period.
- Refunds. Subscription fees are non-refundable except where required by law, and we do not provide refunds or credits for partial periods. You may cancel at any time, effective at the end of the current billing period. For free trials, cancel before the trial ends to avoid being charged.
- Taxes and changes. Fees are exclusive of taxes, which you are responsible for. We may change fees on reasonable notice, effective at your next renewal.
7. Third-Party Services
The Services rely on third-party platforms and providers, including GoHighLevel, Twilio/LeadConnector, Stripe, Cloudflare, Resend, Google, AI/voice vendors, and any reservation platform you integrate (e.g., SevenRooms, OpenTable, resOS). Your use of the Services is also subject to those providers' own terms and policies. AITableFlow is not responsible for the acts, omissions, availability, or policies of third-party providers, and outages or changes by those providers may affect the Services.
8. Intellectual Property
- Our property. AITableFlow and its licensors own all rights in the Services, the underlying configurations, workflows, automations, methods, software, and the AITableFlow name and brand (the "Platform"). Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services during your subscription for your internal business purposes.
- Your data. As between you and AITableFlow, you own the data you provide and the data generated about your guests ("Customer Data"). You grant us a license to host, process, and use Customer Data as necessary to provide the Services and as described in our Privacy Policy and Data Processing Agreement.
- Restrictions. You may not copy, resell, reverse-engineer, or create derivative works of the Platform, or use it to build a competing service.
- Feedback. If you give us feedback or suggestions, we may use them without obligation to you.
9. Confidentiality
Each party may receive non-public information of the other ("Confidential Information"). The receiving party will protect it with reasonable care, use it only to perform under these Terms, and not disclose it except to those who need to know and are bound by similar obligations. This Section does not apply to information that is public, independently developed, or rightfully obtained from a third party, or where disclosure is legally required.
10. Disclaimers and Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT AI OUTPUTS WILL BE ACCURATE, THAT EVERY RESERVATION OR ORDER WILL BE CAPTURED CORRECTLY, OR THAT THE SERVICES WILL ACHIEVE ANY PARTICULAR BUSINESS RESULT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- AITableFlow WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.
- AITableFlow'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO AITableFlow FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You will defend, indemnify, and hold harmless AITableFlow and its members, officers, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your Customer Data; (c) your communications with your guests; (d) your violation of these Terms or of any law, including TCPA, telemarketing, anti-spam, and call-recording laws; or (e) your violation of the rights of any third party.
13. Term and Termination
These Terms apply while you use the Services. You may terminate by cancelling your subscription. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Services unlawfully, or as needed to protect the Services or others. On termination, your license to use the Services ends; provisions that by their nature should survive (including Sections 8–12, 14) will survive. Return and deletion of Customer Data on termination are governed by our Data Processing Agreement.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws rules. Before initiating any formal proceeding, the parties will first attempt in good faith to resolve any dispute informally by contacting the other party and engaging in discussions for at least thirty (30) days. If the dispute is not resolved informally, the parties submit to the exclusive jurisdiction of the state and federal courts located in Illinois, and waive any objection to venue there.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
16. Miscellaneous
These Terms, together with the Privacy Policy and any Data Processing Agreement or order, are the entire agreement between the parties regarding the Services. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
